Waiver and Release of Liability

By participating in My Boston Singaporeans 3rd National Day Celebration, I agree with the following:

  1. I understand that, in this document,
    • "Activity" means My Boston Singaporeans 3rd National Day Celebration.
    • "Releasees" means the Activity holders, organizers, coordinators, sponsors, and volunteers, and My Boston Singaporeans and/or their directors, officers, employees, volunteers, representatives, and agents.
  2. I HEREBY ASSUME FULL RESPONSIBILITY FOR ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the Releasees or because of their possible liability without fault.
  3. I certify that I am physically fit, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this Activity.
  4. I acknowledge that this document will be used by the event holders, sponsors, and organizers of the Activity in which I may participate, and that it will govern my actions and responsibilities at said Activity.
  5. In consideration of permitting me to participate in this Activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
    1. I WAIVE, RELEASE, AND DISCHARGE the Releasees from any and all liability, including but not limited to, liability arising from the negligence or fault of the Releasees, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this Activity;
    2. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Releasees from any and all liabilities or claims made as a result of participation in this Activity, whether caused by the negligence of the Releasees or otherwise.
  6. I acknowledge that the Releasees are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific Activity on their behalf.
  7. I acknowledge that this Activity carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, the following:
    1. Risks related to food and water consumption, including, but not limited to foodborne illnesses, food poisoning, allergic reactions, anaphylaxis, choking, increased risk of chronic illness, and waterborne illnesses
    2. Risks related to being outdoors, including, but not limited to sunburn, heatstroke, heat exhaustion, dehydration, animal bites, animal attacks, slips, trips, and falls, sprains, exhaustion, being hit by falling objects, lightning strikes, haze inhalation, smoke inhalation, crime, terrorism, traffic accidents, and vehicular collisions
    3. Risks related to social gatherings, including, but not limited to social mistreatment, ostracism, rejection, bullying, harassment, slander, verbal abuse, emotional stress, emotional harm, psychological trauma, mental suffering, mental illnesses, altercations, fights, and transmission and contraction of communicable diseases including Covid-19 and tuberculosis
    4. Other risks caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the Activity. These risks are not only inherent to participants, but are also present for volunteers.
  8. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this Activity.
  9. I understand that while participating in this Activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the Activity holders, producers, sponsors, organizers, and assigns.
  10. I understand that I can leave the Activity at any time.

The Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under the laws of the Commonwealth of Massachusetts. I agree that the laws of the Commonwealth of Massachusetts shall govern this Waiver and Release of Liability.

If my minor child, children, ward, or wards participate(s) in the event, I consent to this Waiver and Release of Liability on behalf of my child, children, ward, or wards.

I acknowledge that nothing in this document guarantees that the Activity will occur.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I AGREE TO IT OF MY OWN FREE WILL.
